Juveniles

The Municipal Court has jurisdiction over juveniles (10-16 years of age) charged with Class C misdemeanor offenses.

  • All juvenile defendants who were under the age of 17 at the time of receiving the citation must appear in open Court before the Judge for their initial appearance. Code of Criminal Procedure, Art. 45.0215 (a)
  • A parent or legal guardian is also required to attend the hearing with the defendant. Art. 45.0215 (d) states 'failure of the parent to appear may result in arrest and is a Class C misdemeanor’.
  • These hearings are scheduled by the Juvenile Case Manager. Notices to appear at the first appearance hearing are mailed to the defendant and will contain the date and time.
  • Your first appearance is to determine your plea. The plea must be made by the defendant charged with the offense. If a plea of not guilty is entered, you will need to meet with the prosecutor. That meeting may be the same day or a future date, based on availability.

Juveniles who fail to appear in court may have an additional charge of “failure to appear” filed against them. Juveniles who fail to appear or who fail to pay their fine will be reported to the DPS, which will suspend or deny issuance of their driver’s license.

Juveniles who disobey a court order may be found in contempt of court and assessed a fine not to exceed $500 or referred to juvenile court for contempt. Additionally, their driver’s license may be suspended or denied until they have fully complied.

Conduct & Attire

All persons entering the court are to be dressed appropriately. Shorts, halters/midriff tops, T-Shirts with vulgar or obscene illustrations, excessively baggy pants, and/or soiled or torn clothing are inappropriate. Every person shall also obey the court rules and shall conduct themselves in a respectful and courteous manner. The Bailiff will remove any person in violation of the dress code or for being disruptive in court.

Juvenile Notifications
 
You and your parent or guardian have an obligation to inform the court in writing each time you change your address. You must notify the court within seven days of each change of address. This obligation continues until your case is fully resolved all fines and court costs are paid or discharged. 45.057 (h), Code of Criminal Procedure

Community Service

Performance of community service hours may be a requirement of your court order. Below is a list of community service agencies in the Cedar Park area and neighboring cities that have been pre approved by the Municipal Court Judge. It is the responsibility of the defendant to contact the agency chosen to work and arrange hours to be worked to satisfy the sentence. Agencies other than the ones listed above need to be approved prior to working there. Community service hours must be performed at a non-profit organization. Community service hours are ordered on a case-by-case basis. You must make sure that the community service hours you perform are compliant with what is ordered in your specific case.

Service Learning
 
Service learning options are Ordered on a case-by-case basis. Before completing any of these options, you must make sure that they were Ordered in your case. Please note: Service Learning options are not acceptable for court ordered community service hours. Please see the Community Service section if you were ordered to perform community service.
Expunction
 
The attached chart should not be construed as legal advice. It is attached solely for the purpose of providing procedural information. In order to request an Expunction, please contact the Juvenile Case Manager. There is a non-refundable fee of $30 that will be due at the time you file for expunction with the court. Please read the application to attached chart to determine if you are eligible to request an Expunction before contacting court.
 

Juveniles Now Adults

If you are now over 17 years of age and received a citation for an offense which occurred when you were under 17 years old, you are still subject to the laws regarding that particular case. If you have questions regarding how to handle your case, please contact the Juvenile Case Manager. If you do not resolve these unadjudicated cases, you may be subject to additional adult charges and penalties, and a warrant could be issued for your arrest.
